Terms of sales

1. Purpose and Seller
These Terms of Sale govern all purchases of digital content made within the Game *OneTouch*, published by FROM THE FRENCH, a simplified joint-stock company (*société par actions simplifiée*) with share capital of €216, registered with the Lyon Trade and Companies Register under number 919 148 056, whose registered office is located at 62B avenue Leclerc, 69007 Lyon, France. Intra-community VAT: FR57 919 148 056 — SIRET (registered office): 919 148 056 00022 — APE code: 5829C. Represented by its President, Mr Guillaume Franc.

2. Digital Products
The Game offers in-app purchases including virtual currencies (Hard Currency and Soft Currency), cards, packs and bundles, and cosmetic items. All items are digital, are licensed and not sold, and have no real-world monetary value.
3. Randomised Content and Drop Rates
Certain packs or bundles may grant items determined on a random basis. Where this is the case, the probabilities of obtaining each category of item ("drop rates") are clearly disclosed within the Game before purchase, in compliance with Apple App Store and Google Play requirements. Randomised items have no real-world monetary value and cannot be exchanged, sold, or redeemed for money.
The availability of paid randomised content depends on your country of residence. Where the law of your territory restricts or prohibits paid randomised content, such content is disabled, modified, or made available only through non-paid means in that territory.
4. Pricing
Prices are displayed through third-party platforms, including the Apple App Store and Google Play Store, in your local currency and inclusive of applicable taxes. Prices may be modified at any time; the price displayed at the moment of purchase applies.
5. Payment Processing and Seller of Record
All payments are processed by the relevant third-party platform (Apple or Google), which may act as seller or merchant of record for the transaction. From the French does not collect or store your payment details.
6. Virtual Currency
The Game includes a premium currency (“Hard Currency”) and a non-premium currency (“Soft Currency”). These currencies do not expire while your account is active, are non-transferable, and cannot be redeemed for real money.
7. Delivery
Purchased digital items are delivered immediately upon successful payment confirmation.
8. Right of Withdrawal
Digital content is supplied immediately upon your express request. By completing a purchase, you expressly request immediate performance and acknowledge that, once delivery has begun, you lose your statutory right of withdrawal, in accordance with Article L221-28 of the French Consumer Code and Directive 2011/83/EU. This express request and acknowledgment are collected at the point of purchase, and confirmation of your order is provided to you on a durable medium by the platform (Apple or Google) through which the purchase is made.
9. Refund Policy
Because purchases are processed by the platforms, refund requests must be submitted directly to the relevant platform (Apple or Google) under its refund policy. From the French does not process platform refunds directly, without prejudice to your mandatory legal rights.
10. Purchases by Minors
Purchases by a minor require the prior consent of the holder of parental authority. We strongly recommend enabling platform-level purchase controls (Family Sharing / parental controls / Ask to Buy). Nothing in these Terms affects any right a parent or guardian may have under applicable law to dispute an unauthorised purchase made by a minor.
11. No Resale or Transfer
You may not sell, trade, or transfer any purchased digital content or virtual currency outside the mechanisms expressly provided within the Game.
12. Modification of Offers
From the French may modify pricing, change available content, or discontinue products at any time. Changes do not affect items already purchased, subject to clause 13.
13. Liability
To the extent permitted by law, From the French shall not be liable for payment issues attributable to third-party platforms, service interruptions, or loss of virtual items due to technical issues beyond its reasonable control. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Consumer Mediation
In accordance with Articles L611-1 et seq. of the French Consumer Code, a consumer is entitled to use a consumer mediator free of charge to settle a dispute, after first submitting a written complaint to our customer service and failing to obtain a satisfactory response within two months. The mediator designated by From the French is: CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France — www.cm2c.net.
15. Governing Law and Jurisdiction
These Terms of Sale are governed by French law. This does not deprive a consumer of the mandatory protections of the law of their country of residence. Disputes fall under the jurisdiction of the competent French courts; a consumer may also bring proceedings before the courts of their place of residence.
